Safety Rules
If an accident happens at work, workers’ comp insurance will cover it automatically, right? Well, maybe. There is a difference between an injury happening at work and the injury being work-related. In order for a workers’ comp claim to be accepted, the accident must have happened “within the course and scope of employment.” Thus, it is critical for employers to fully investigate and document all injuries, so adjusters can make informed decisions about compensability. In most states, the law gives employers 5 statutory defenses (intoxication, self-inflicted injury, horse-play, suicide, and initial aggression in an altercation).
